This End-User License Agreement ("EULA") is a legal agreement between you and Epistemy Press LLC (“Epistemy Press”) for the purchased electronic book which may include associated software components, media, printed materials, and "online" or electronic documentation ("E-Book"). By installing, copying, downloading, or otherwise using the E-Book, you agree to be bound by the terms of this EULA. This license agreement represents the entire agreement concerning the ebook between you and Epistemy Press and it supersedes any prior proposal, representation, or understanding between the parties. If you do not agree to the terms of this EULA, do not install, download, or use the E-Book. The E-Book is licensed, not sold.

1. Grant of License. Epistemy Press has authorized download by you of one copy of the E-Book subject to the terms and conditions set forth in this agreement. Epistemy Press grants you herein a nonexclusive, nontransferable license to use the E-Book according to the terms and conditions set forth. This License Agreement permits you to download and install the E-Book for your use only in accordance with instructions to be furnished to you by Epistemy Press, which instructions shall be kept confidential and not transferred or disclosed by you to any third party. Furthermore, you understand, acknowledge and authorize Epistemy Press to digitally watermark the E-Book with your name, e-mail address and order details in order to identify you as an Authorized User.

2. Restrictions.  You shall not: (1) resell, rent, assign, timeshare, distribute, or transfer all or part of the E-Book or any rights granted hereunder to any other person; (2) duplicate the E-Book, except for a single backup or archival copy; (3) remove any proprietary notices, labels, or marks from the E-Book; or (4) transfer or sublicense title to the E-Book to any other party. Notwithstanding the foregoing, you may print a reasonable number of pages from the E-Book for your personal use not to exceed ten (10%) of the total content of the E-Book. Furthermore, it is understood that you may transfer and read the E-Book between devices owned by you as the Authorized User.

3. Intellectual Property Protection.  The E-Book is owned by Epistemy Press and is protected by United States and international copyright and other intellectual property laws. Epistemy Press reserves all rights in the E-Book not expressly granted herein. This license and your right to use the E-Book terminate automatically if you violate any part of this Agreement. In the event of termination, you must destroy and delete the original and all copies of the E-Book.

4. Limited Warranty.  Epistemy Press warrants that the files containing the E-Book, a copy of which you are authorized to download, are free from defects in the operational sense that they can be read by a standard e-book reader. EXCEPT FOR THIS EXPRESS LIMITED WARRANTY, EPISTEMY PRESS MAKES AND YOU RECEIVE NO WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR IN ANY COMMUNICATION WITH YOU, AND EPISTEMY PRESS SPECIFICALLY DISCLAIMS ANY OTHER WARRANTY INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. EPISTEMY PRESS DOES NOT WARRANT THAT THE OPERATION OF THE E-BOOK WILL BE UNINTERRUPTED OR ERROR FREE. EPISTEMY PRESS MAKES NO WARRANTIES RESPECTING ANY HARM THAT MAY BE CAUSED BY THE TRANSMISSION OF A COMPUTER VIRUS, WORM, TIME BOMB, LOGIC BOMB, OR OTHER SUCH COMPUTER PROGRAM. EPISTEMY PRESS FURTHER EXPRESSLY DISCLAIMS ANY WARRANTY OR REPRESENTATION TO AUTHORIZED USERS OR TO ANY THIRD PARTY. If the E-Book was licensed in the United States, the above exclusions may not apply to you as some states do not allow the exclusion of implied warranties. In addition to the above warranty rights, you may also have other rights that vary from state to state.

5. Limitation of Liability.  IN NO EVENT WILL EPISTEMY PRESS BE LIABLE FOR ANY DAMAGES, WHETHER ARISING FROM TORT OR CONTRACT, INCLUDING LOSS OF DATA, LOST PROFITS, OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE E-BOOK.

6. General.  This Agreement constitutes the entire agreement between you and Epistemy Press and supersedes any prior agreement concerning the E-Book. This Agreement is governed by the laws of the State of New York, without reference to its conflicts of laws provisions.
